Capitol Square Review and Advisory Board v. Pinette

Impact

This case considered the difficult question of freedom of speech versus freedom of religion. Under the U.S. Constitution both are of equal of importance. Yet, the problem for government officials in Columbus, Ohio and others faced with this dilemma is to refrain from restraining freedom of speech without seeming to endorse a particular religion. Capitol Square Review went a long way in establishing a test or standard for maintaining this important balance. As long as the area is opened to any and all, it cannot be constructed as endorsing an establish religion. However, maintaining that balance remains a delicate balancing act.
